Federal Legislation on Eminent Domain
On November 3, 2005, the U.S. House of Representatives passed H.R. 4128, the Private Property Rights Protection Act of 2005, which would sharply restrict the use of eminent domain for economic development by withholding federal funds from communities that use eminent domain for traditional economic development purposes. The bill passed with 376 ayes, 38 nays, 19 present/not voting. As of summer 2006, the Senate had not voted on the bill.
